A Refresher on Common Divorce Mistakes to Avoid

Pleasanton CA divorce attorneyWith each passing year, divorce rates have decreased a bit across the United States. That said, plenty of people are still getting divorced year after year, and we thought we’d take some time to offer a refresher on a key topic: common divorce mistakes.

Having served the local community for years, we at the White Oak Law have seen it all. This includes the common mistakes that lead to unfavorable outcomes or otherwise carry significant implications. If you’re in the middle of a divorce, or are preparing for an upcoming divorce, make sure to keep these common mistakes in mind!

Don’t let your emotions run unchecked: Divorce is an incredibly stressful and intense time. Despite this, it’s critical that you maintain a cool, logical head at all times so that you can make smart decisions along the course of the complex divorce process.

Don’t carry unrealistic expectations: Divorce is a life-altering event and we’ve found that many people underestimate just how different things will be, especially in regards to finances. Remember, your financial life will look significantly different once you’re on your own. This is just one aspect to remember; ultimately, you need to remain grounded and prepare for the reality of your specific circumstances.

Don’t argue with the judge: While it’s hard to fully keep emotions in check, lashing out at the judge or the court in general is a terrible idea. This also involves refusing to follow court orders and showing disrespect to the court in any way. Let your attorney lead the interactions and make sure you always put your best foot forward no matter what.

Don’t get the kids involved: We see this far too often – parents want to restrict parenting time or “take the kids away” from the other parent due to vindictive reasons rather than genuine concern for the child. Never try to weaponize your children no matter how upset you might be at the ex, this is unfair to everyone involved and shows a lack of regard for your child’s mental, physical, and emotional well-being.

Don’t skip hiring your own attorney: Never ever trust your ex when it comes to using his or her own attorney. You should always have your own legal representation, even in divorces that might be otherwise amicable or where feelings are mutual. We’ve seen too many trusting people taken advantage of by an ex simply because they didn’t have someone to represent their side. Don’t take any unneeded risk and take the time to consult with your own attorney.
